North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free of recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to being struck by or crushed by a powered industrial truck in the event of an upset: a)establishment - Toyota forklift was not equipped with a seatbelt. An employee was observed operating the forklift without a seatbelt which could result in the employee being thrown from the lift truck in the event of a vehicular accident. ABATEMENT NOTE: One feasible and acceptable method to correct this hazard is to retrofit the forklift with a seatbelt.
