North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or crushed by a forklift in that the employer did not ensure that a seat belt was provided on a forklift: a)facility; a seat belt was not installed on the employer's Allis-Chalmers type LPS forklift, model #ACC 60K LSPS, serial #AFL133342. Among other methods, one feasible and acceptable means of abatement is to install on the forklift an approved seat belt.
