NCGS 95-129(1) section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard as a result of tipover while operating a powered industrial vehicle for failure to use the operator restraint devices or seat belts: a)shipping/receiving area- an employee was observed operating the Clark forklift(model# 050040/serial#35516264635), without the use of the seat belt. ABATEMENT NOTE: Among other methods, one feasible method to reduce this hazard is to follow the requirements of ANSI B56.1, Consensus Standard for Powered Industrial Trucks, in addition to requiring employees to use the restraint devices and/or seat belts.
