Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about August 13, 2008 and at times prior thereto, with respect to the jobsite located at the Arkansas Otolaryngology Clinic, where employees were engaged in grounds keeping activities. Employees were operating a Gravely Promaster 148Z zero turn radius mower on a slope greater than the seventeen degrees recommended by the manufacturer, a condition that exposed the employees to the hazards of being crushed, trapped, or thrown during the event of a rollover. One feasible and acceptable means of abatement, among others, is to train employees in hazard recognition and to follow the operators manual for equipment they may be allowed to operate.
