Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about September 11, 2008, on the north side of the new pre-fabricated metal warehouse building located at Porocel Corporation, 10300 Arch Street Pike, Little Rock, Arkansas, an employee of MTG Metal Erectors, Inc. was in an elevated scissor lift directly beneath a suspended load of roofing panels estimated to weigh approximately 900 lbs. The employee was stretching insulation around the eave of the roof and was exposed to being crushed by the suspended load if the hydraulics on the Skytrak that was being used to elevate the load inadvertently failed and the lifting components dropped. One feasible means of abatement would be to not allow employees to stand or pass under the elevated portion of any rough terrain forklift truck, whether empty or loaded as referenced in ASME B56.6.6 - 2002, Safety Standard for Rough Terrain Forklift Trucks. In the alternative, place loads on top of roofs and then elevate employee(s) in scissor lift to desired working height.
