Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or crushed-by a collapsing roof: (a)On or about 05/15/08, in the shipping and receiving department, the employer allowed employees to work in an area where repairs were being made to a damaged column that supported the roof, without ensuring that good engineering practices were implemented, including but not limited to, designing and implementing engineered construction documents for the repair and/or replacement of the damaged column. Among other methods, one feasible and acceptable method to correct these hazards is to implement good engineering practices, including but not limited to; designing and implementing an engineering plan for the repair and/or replacement of the damaged column, to include adequate bracing, and performing industry accepted welding and cutting practices.
