employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)At 1620 Oakland Ave, Kansas City - Forklift operators, such as but not
limited
to, the operator driving the #5 Toyota forklift on 09/12/08, were exposed
to
serious physical harm or death resulting from not wearing seat belts when
there
was a potential for the lateral tipover of the forklifts. Reference
paragraph 5.3.19
of the ASME B56.1 - 2000 Safety Standard for Low Lift and High Lift Trucks.
