Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Employees were not using seatbelts when driving forklifts when forklifts were equipped with seatbelts. Feasible and acceptable methods of abatement are: (1) Develop and enforce a seatbelt use policy. Abatement certification is required for this item - use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
