Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a)On December 30, 2008, at 501 South Madison, Street, Webb City, Missouri - Employees were exposed to a fall hazard while working from a bucket of the backhoe approximately 13 feet in the air, while changing the banners, on the shopping center grounds, without any fall protection.
