Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing hazards, and struck against hazards:
a)Establishment - A seat belt was not provided on the Yale fork truck.
b)Establishment - Operators did not wear, nor were they required to wear
the seat
belt provided on the Yale clamp truck.
One method of abatement is to install a seat belt on the Yale fork truck
and require that
employees wear seat belts while operating the lift trucks.ng
