Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm from
chemical burns and
respiratory hazards in that:
(a) On June 19, 2008, an employee was exposed to sulfur dioxide when a
transfer hose
ruptured while transferring sulfur dioxide from a fixed tank on-site to a
tanker truck at
American Crystal Sugar on Highway 81 North in Hillsboro, North Dakota.
Among other methods, one feasible and acceptable method to correct this
hazard would
be to follow the manufacturer's specification Smart-Hose fluid systems
proper
hose use,
care, and maintenance on page 7 to test all hose assemblies as required
every six months
(or sooner) to insure assembly is safe for continued use.
