Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: On november 12, 2008 at the residential construction located in Urb. El Palmar Sur calle Mediterraneo in Carolina, P.R. the employeer Ivan Construction failed when he allowed the inapropiate use of fiberglass stepladder and platform. Employees were exposed to fall and injuries in the construction. The employees were observed accessing the roof of a one story residence 8 feet, using an unfolded fiber glass folding ladder of 10 steps leaning on a vertical external wall. The ladder failed to reach the upper edge of the structure. The instructions on the side of the ladder state a warning that clearly prohibits for folding ladders their use while unfolded. This type of ladder may slip while being used unfolded because they are not designed to operate that way. One method to abate the hazard: Provided adecuate ladder and provided training in workplace to all employees. Hazard: fall El 12 de noviembre de 2008 en la construccion residencial de la Urb. El Palmar Sur calle Mediterraneo en Carolina, P.R. el patrono Ivan Construction fallo en permitir el uso inapropiado de la escala de fibra de vidrio. Los empleados fueron expuestos a caida y lesiones en la construccion. Los empleados fueron observados accesando al techo de una residencia de un piso de 8 pies utilizando una escala de fibra de vidrio plegable de 10 escalones cerrada que estaba recostada de una pared externa. La escala no llegaba al borde superior de la estructura. Las instrucciones en el lado de las escaleras provee un aviso que claramente prohibe que las escalas plegables sean utilizadas mientras estas todavia esten cerradas. Este tipo de escala puede resbalarse mientras es utilizada cerrada debido a que no han sido disenadas para operar de esa manera. Un metodo para corregir el riesgo: Proveer una escalera adecuada y proveer adiestramiento en el lugar de trabajo a todos los empleados. Riesgo: caidao:
