Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to impalement hazards and blunt force trauma: (a)Front Entrance - Day Laborer was observed constructing an entryway right above two 5/8 inch diameter pieces of uncovered protruding metal that were approximately 8 inches in length exposing him to an impalement hazard and blunt force trauma, on or about July 8, 2008. Among other methods, one feasible and acceptable abatement methods to correct this hazard is to establish proper impalement protection, either by using protective caps or placing an acceptable cover over the area to eliminate exposure.
