Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of working at elevated heights with the
emergency lowering control
inoperable:
(a) Maintenance Department - On or about June 10, 2008, the MEC aerial
lift had a inoperable
emergency lowering control. Employees were raised to a height of
approximately 12 feet to
retrieve cutting dies.  Employee were exposed to the hazard of not being
able to be lowered in
the event of an accident or other emergency.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard
is to provide and require frequent and annual inspection, and as specified
by the
manufacturer's manual; and repair the emergency lowering control prior to
placing the unit
in service as prescribed by the American National Standards
Institute/Scaffold Industry
Association ANSI/SAI A92.6-1999 for Self-Propelled Elevating Work
Platforms, Section
6.2(1) and 6.4.2.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
