Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
a)Clean Room: An employee was lifted to a height of approximately 104
inches
while riding on the forks of a powered industrial truck (Yale LM1403).
There
was no platform, guard rails or personal fall arrest system in use, on or
about
12/2/08.
Among others, feasible and acceptable methods to correct this hazard
include, but are not limited
to the following:
1)Provide an additional portable ladder or stair system for use.
2)Provide a work platform for the industrial truck following the
protection
outlined
in the ASME Standard B56.1-2000 paragraph 4.17.3 which includes that the
platform complies with the design requirements in paragraph 7.36.3.
3)Implement precautions for using an industrial truck to elevate personnel
as
outlined in ASME Standard B56.1-2000 paragraph 4.17.2.
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER
IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS
ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY
OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
