Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to unguarded in-going nip points: a)Production Area, Press Brake Department: Where point of operation guarding was not feasible, the employer did not develop and implement a minimum safe distance program for the protection of employees who operated the Verson Allsteel Press and the Clearing Niagara Press, observed on or about 9/17/08. One feasible and acceptable abatement method is to develop and implement a safe distance program that conforms to the requirements of ANSI B11.3-1982, Paragraph 6.1.4.3 and OSHA Directive CPL 2-1.25. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
