Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to possible overturning of the aerial lift:
a)Construction Site, 317 Rte 541 Bypass, Mt Holly, NJ -  Employer used
the JLG Model 400S aerial lift Sr #0300134833 as a crane to lift
approximately 5-6 25' tall light poles and set them into position on the
ground, on or about 12/10/08.
NOTE:  BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY
DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT
SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF
THIS VIOLATION AS NORMALLY REQUIRED AS PER 29 CFR 1903.19.
One feasible and acceptable means of abatement would be for the employer to
comply with the operator's manual and not use the aerial lift as a crane.
