Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Site location, Rt 9 & memorial Drive. Waretown NJ. Where employee was operating a vehicle-mounted elevating and rotating work platform with out a complete platform top-rail/other structure. The employer did not develop and implement a program to protect employee to operate a vehicle-mounted elevating and rotating work platform with a complete platform top-rail/other structure. Observed on or about 01/05/09. One feasible and acceptable abatement method is to develop and implement a complete top-rail/other structure that conforms to the requirement of ANSI A92.2-1969, Section 4 Paragraph 4.5 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
