Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while performing overhead work on an aerial lift in an area where fork-truck traffic was present and that before and during use of an aerial platform workplace inspections were not performed to assure that unauthorized personnel were not in the work area . On or about 6/19/08 employees were performing work from an elevated scissor's lift removing overhead exhaust ventilation in the "Old Haven Area" where fork-truck traffic was present. This work area was not barricaded by cones and/or caution tape to prevent accidental contact of fork- trucks with the scissor's lift nor was this area being observed for the presence of unauthorized personnel. An employee was struck by over-head duct-work during the removal of the ductwork. This employee incurred serious injuries as a result of being struck-by the ductwork. ABATEMENT METHODS: Feasible means of abatement to correct these hazards include; Follow the guidelines listed in ANSI/SIA A92.6-1999 section 7.10 item #10 which states, " When other moving equipment and vehicles are present, special precautions shall be taken to comply with local ordinances or safety standards established for the workplace. Warnings such as, but not limited to, flags, roped off areas, flashing lights, and barricades shall be used as appropriate. Follow the guidelines listed in ANSI/SIA A92.6-1999 section 7.8 item #9 which states, "Before the aerial platform is used and during use, the user shall check the area in which the aerial platform is to be used for possible hazards such as, but not limited to...(9) Presence of unauthorized persons." Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).n
