Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to furnish employment free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees as follows: (a)At the CityCenter construction site, a Manitowoc 2250 crawler crane was in operation, shaking out steel just north of the Mandarin Oriental tower. At some point, the Oiler for the crane was standing to the west of the tracks and north of the crane's counterweights. The crane rotated clockwise, causing the Oiler to become trapped and crushed between the track and counterweights. The Oiler sustained fatal injuries. Based on interviews with multiple Operators of the Manitowoc 2250 and on observation of operations, employees operating cranes did not sound the horn prior to swinging per the manufacturer's requirements. Reference: Manitowoc 2250 Operator's Manual Section 3 - Operating Controls and Procedures, page 3-29: DANGER. Moving Crane Hazard! Counterweights can strike personnel in area of swing path! Warn personnel to stay clear of swing path. Sound horn prior to swinging. Section 2 - Safety Information, page 2-4: WARNING. Crush Hazard! Rotating bed can swing into and crush personnel climbing on or off crane. To prevent death or serious injury: - Operator: Always sound horn to alert personnel before you swing or travel. One feasible means of abatement would be to ensure the manufacturer's requirements for crane operation, are followed.,
