Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to ensure employment was free from recognized hazards as follows: (a)At the Eastern and Warm Springs Commercial Center construction site, two employees were installing a sign on the Just Brakes building, and were working from a Elliott Hi-Reach Equipment Company vehicle-mounted aerial platform while tied off to the top and mid rails of the basket instead of the appropriate attachment point located on the end of the boom. The employees were exposed to possible serious injuries from falls of approximately 10 to 12 feet due to the incorrect use of fall protection. Reference: Elliott Hi-Reach Equipment Company Operating Instructions Part 4. Aerial Lift Operation a) Personal Protection Equipment. "...all personnel in the platform shall wear a safety harness with an energy absorbing lanyard attached to the lanyard attachment point." One feasible means of abatement would be to follow the manufacturer's requirements for fall protection on the platform.
