Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to furnish employment free from recognized hazards as follows: (a)In the back room of the Samsonite Black Label store, merchandise was stored on the "ceiling" of the bathroom, which was approximately 8 feet 8 inches high. Employees accessed that area using an 8-foot A-frame ladder, and had to use the top step and top of the ladder to get up there. Employees were exposed to possible serious injuries from falls due to the incorrect use of the ladder. Reference: ANSI/SIA 14.5 - 2000 American National Standard for Ladders - Portable Reinforced Plastic - Safety Requirements Section 9.3.2 Climbing and Working Locations The user shall not step or stand on a ladder top cap and the top step of a step or trestle ladder. One feasible means of abatement would be to follow the requirements of ANSI/SIA 14.5 - 2000.
