Nevada Revised Statute 618.375(1):  The employer failed to furnish
employment and a place of
employment which was free from recognized hazards that were causing or
were likely to cause
death or serious physical harm to his employees:
The employer failed to ensure that the place of employment was free of
recognized hazards in
that:
At Echelon Resort construction project, falsework shoring at Shangri-La
basement, the crew of
ten carpenters were in process of dismantling Al-speed frame shoring
towers.  Some employees
worked from the scissor lifts and while others climbed on shoring end
frames and worked from
a two plank "platform" placed across the frames.  All employees were
required to use fall
protection.  At approximately 0720 hrs. employee #1 was in the process of
dismantling the
frame shoring and was two sections high.  Employee #1 mistakenly connected
his lanyard to the
same A-frame he was removing on third section and threw the frame to the
ground.
Employee
#1 was pulled off the planks he was standing on and fell 13 feet to the
ground below where he
struck his head and sustained massive head injuries:
a.The crew foreman directed employees to work alone, to throw all shoring
system
components to the ground and rushed them to hurry-up which deviated from
the
"common" practice for falsework removal, from the company established
procedure as well as from the manufacturer/supplier specifications noted
in the
Design Plans.

erection should be
executed in accordance with applicable codes, the recommendations of the
Scaffolding, Shoring
and Forming Institute, Inc. and good working practices.

Frame Shoring, I. General Guidelines - (G) Erect, dismantle or alter
shoring only under the
supervision of a qualified person. (H) Do not abuse or misuse the shoring
equipment. (M) Do
not use shoring systems for fall protection.
III. Guidelines for Dismantling Shoring - (D) Lower shoring components in
a safe manner.  Do
not drop or throw components as this could result in injury to personnel
or damage to
equipment.
One feasible and acceptable abatement method would be to make sure that
each employee
assigned to dismantle shoring systems is trained to recognize hazards
associated with assigned
job tasks, to follow the manufacturer/supplier Design Plan notes, to
follow the company Job
Safety Assessment and to follow guidelines of safe practices recommended
by the
Scaffolding,Shoring and Forming Institute.g,Shoring
