Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to provide employment free from recognized hazards as follows: (a)At the Cosmopolitan project, Casino Level, an employee was working from a Genie GS-3246 scissor lift and stood on the midrail to gain additional height. The employee was exposed to possible serious injuries should he fall over the short side of the lift to the concrete floor, at least 10 feet below. Reference: ANSI/SIA 92.6 - 1990 American National Standard for Self-Propelled Elevating Work Platforms Section 8.10.1 Personnel Footing. Personnel shall maintain a firm footing on the platform floor while working thereon. One feasible means of abatement would be to follow the requirements of ANSI/SIA 92.6 - 1990 as well as ensure that appropriate training is provided prior to an employee using the equipment.e
