Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to ensure that a utility vehicle was not modified, as follows: a.At the Monte Carlo Automated People Mover station construction site, two employees were exposed to moving vehicle hazards while operating a utility vehicle (make: John Deere, model: TS) that contained unauthorized modifications that contributed to the vehicles unsafe operation. The employer allowed the utility vehicle to be modified by installing a pair of racks for purposes of transporting material. The vertical member on one of the racks slipped downward through its opening while the vehicle was in motion and struck a small mound of cured concrete located on the road on which the employees were traveling. The contact of the rack with the concrete caused the vehicle to stop abruptly - - throwing the employee in the passenger seat against the dash of the utility vehicle. Reference: Gator Utility Vehicle TS and TH 6x4 Operator's Manual, Safety, Page 7: Do Not Modify Machine: Do not make any unauthorized modifications to the machine in anyway. One feasible means of abatement would be to remove the material racks from the utility vehicle.
