Nevada Revised Statute 618.375(1): Every employer shall furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees: At the StoneWorld Company, Inc., 7375 Tule Springs Road, Las Vegas Nevada 89131, the employer failed to protect employees from serious and recognized hazards, as follows: a)Eagle Picher Forklift model RC60T, serial #2PJ01313, type D and Caterpillar Forklift model RC60T, serial #2PJ00814, type D, were not equipped with a restraint device (seat belts). The employees were exposed to possible serious injury in case of a tipover. Reference: ASME B56.1-1993 Safety Standard for Low Lift and High Lift Trucks Section 7.39(a) Operator Restraint Systems. Counterbalanced, center control, high lift trucks that have a sit-down non elevating operator position shall have a restraint device, system, or enclosure that is intended to assist operator in reducing the risk of entrapment of the operator's head and/or torso between the truck and the ground in the event of a tipover. Such means shall not unduly restrict the operation of the truck, e.g., the operator's mounting, dismounting, movement, and/or visibility. One feasible means of abatement is to follow the requirements of ASME B56.1- 1993 by equipping the lifts with restraint system.nt
