Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer failed to protect employees, as follows:
a.At the M Resort construction project, 12300 Las Vegas Boulevard South,
Las
Vegas, NV.  An employee on the scissor lift was installing zinc flashing,
this
employee was elevated more than 15 feet with the chain dangling on the
side and
not secured for the equivalent structure used in place of mid-rails.  The
employee
was exposed to possible serious injuries or death from potential fall
hazard of
more than 15 feet in elevation.

Para 4.12.2.2 Mid-Rail. the guardrail system shall include a mid-rail
approximately midway  between the top rail and the platform surface.
Equivalent
structure may be used in place of mid-rails, but shall meet the strength
requirements described in 4.12.2.4.
One feasible and acceptable abatement is to ensure that employees follow
all
safety rules on the proper operation of scissor lifts.r
