Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The Vice President and the Foreman did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crush hazard: a) Production/Kiln Area: An employee was observed operating a Toyota fork truck without the use of a seat belt. The left side strap of the belt was missing from the seat of the fork truck for at least one month, exposing the operator of the daily use truck to possible crushing injury or death if the lift were to sustain a roll over incident. a) Among other methods, one feasible and acceptable method to abate this hazard is to follow the guidelines and recommendations set forth in the manufacturers operating manual for this particular fork lift. (Toyota Operators Manual 6FGU15.18.20.25.30, page #9 states: The operator must utilize the seat belt when operating the vehicle....) b) Among other methods, one feasible and acceptable method to abate this hazard is to follow the safety standard 5.3.19, Industrial Truck Standards Development Foundation (ITSDF B56.1-2005, Page #10, stating: An active operator protection device or system, when provided, shall be used). ABATEMENT CERTIFICATION REQUIRED
