Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing injuries from overhead (underhung) hoists. a) Kill Floor: The roller hoist was not marked with its rated load capacity legible from the floor, as observed on or about November 12, 2008. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS TO MARK THE RATED LOAD CAPACITY OF THE ROLLER HOIST AND CONDUCT FREQUENT AND PERIODIC INSPECTIONS PER ASME B30.16, OVERHEAD HOISTS (UNDERHUNG). ABATEMENT CERTIFICATION REQUIREDATION
