Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a crush hazard:
a) Warehouse: The general manager operated the Nisson 50 fork truck
without the use
of a seat belt while removing a skid from the back of a truck, exposing
the general
manager to possible crushing injury or death if the lift were to sustain a
roll over
incident, on or about 04/08/09.
a) Among other methods, one feasible and acceptable method to abate this
hazard is to follow
the safety standard 5.3.19, Industrial Truck Standards Development
Foundation (ITSDF
B56.1-2005, Page #10, stating: An active operator protection device or
system, when
provided, shall be used).
b) Among other methods, one feasible and acceptable method to abate this
hazard is to
follow the manufacturers operating instructions for this Nisson 50 Optimum
fork truck,
which prominently displays a warning sticker adjacent to the drivers seat
stating: During
operation lift truck operator must wear a seat belt.

employees were exposed to a fall hazard:
a) Shop Area: A mechanic positioned himself on a wooden pallet attached to
the forks
of the GPX30 fork truck, and was elevated to a height of approximately 16
feet
above
the shop floor to change out a light bulb, and did not utilize any type of
fall
protection, on or about 01/10/09.
a) Among other methods, one feasible and acceptable method to abate this
hazard is to use a
platform meeting the design and use criteria set forth in the Industrial
Truck Standards
Development Foundation (ITSDF) B56.1-2005 standard.

a) Yard Area/Grove Crane: A Grosly metal shackle used with a synthetic
nylon web
sling was distorted with it's ears spread approximately 1/2 inches beyond
normal
making it impossible to seat the screw pin, on or about 04/22/09.
a) Among other methods, one feasible and acceptable method to abate this
hazard is to follow
the manufacturer's recommendations for use of shackles and to follow ASME
B30.26-2004
Standards for Rigging Hardware Chapter 26-1.
