Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recogn ized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a) 510 Grandv iew Place, South Williamsport, PA: The operator of a Caterpillar 303.5C CR Mini Hydraulic Excavator operated the excavator without wearing the seatbelt provided by the manufacturer for protection from crushing injuries in case of roll over, observed on or about 10/14/09. Among other methods, one feasible method to abat e this hazard is to follow the manufacturers recommendation set forth in the ope rating manual for this particular excavator. ABATEMENT CERTIFICATION REQUIRED
