Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to crushing injuries in the event of an accident/equipment roll over and the provided seat belt was not utilized: a) Route 81 bridge over Lidy Rd., Dupont, PA: The provided seat belt was not worn by the operator of the Ingersoll Rand SD 70 Pro Pac Vibratory Soil Compactor, as observed on or about December 3, 2009. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD INCLUDE, BUT NOT LIMITED TO, ENFORCE EMPLOYEE USAGE OF SEAT BELTS WHEN OPERATING EQUIPMENT AND FOLLOW THE MANUFACTURE'S REQUIREMENTS. ABATEMENT OBSERVED DURING INSPECTION NO CERTIFICATION REQUIRED
