Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by hazards: a) Middle Creek Bridge, Lake Ariel, PA: Four employees stripping forms off of the newly poured sidewalls of the bridge were working and walking on the road but were not wearing reflective clothing, on or about December 4, 2009. ABATEMENT CERTIFICATION REQUIRED AMONG OTHERS, ONE FEASIBLE AND REASONABLE METHOD OF ABATEMENT IS TO: train the employees in the aspects of Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition), which are incorporated by reference in '1926.200(g)(2), and enforce the employees need and use of personal protective equipment.
