Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to severe burn injuries from a dust fire or explosion created by dust collectors inside a building: a) Bindery area: The employer does not ensure that the work place is free from fire hazards within the dust collection system. An enclosureless dust collector that collects dust from the Wohlenburg Perfect binder and Heidelburg saddle stitchers, exceeds a maximum air handling capacity of 5000 CFM and is located inside of the building. A specific instance of this violation was observed on or about December 10, 2009 and the violation continues through the present. b) Bindery area: The employer does not ensure that foreign material can not enter the dust collection system. The Maren floor level shredder unit is not provided with a means to prevent foreign material from entering the system. A specific instance of this violation was observed on or about December 10, 2009 and the violation continues through the present. c) Bindery area: The employer does not ensure that a deflagration propagation can not occur between pieces of equipment. Isolation devices are not provided to prevent deflagration propagation between pieces of equipment, such as but not limited to, the Wohlenburg Perfect binder, Heidelburg saddle stitchers, baler units and the dust collector, connected by duct work. A specific instance of this was observed on or about December 10, 2009 and the violation continues through the present. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS FOLLOW THE CRITERIA REQUIRED BY NFPA 654. Pursuant to 29 CFR 1903.19 abatement certification and documentation is required within 10 days after the abatement date. The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of the abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
