Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the employee
was exposed to: struck by hazards due to moving construction vehicles and
public traffic:
a) Jobsite Route 33/209 North, Bartonsville - Three employees working
within the
construction work zone with vehicular traffic could not be easily seen by
drivers or heavy
equipment operators, thereby exposing the workers to a hazard, on or about
2-22-10.
ABATEMENT CERTIFICATION REQUIRED
Among other methods, feasible and acceptable methods to correct this hazard
are:
a)  to require all employees, in a construction zone exposed to vehicular
traffic, to wear high-
visibility garments at all times while in the construction zone.
b) to comply with The Federal Highway Administration's recent issuance of
their final rule,
Worker Visibility, 23 CFR Part 634, which states: "All workers within the
right-of way of a
Federal-aid highway who are exposed either to traffic (vehicles using the
highway for purposes
of travel) or to construction equipment within the work area shall wear
high-visibility safety
apparel."bility
