Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential atmospheric and/or toxic gas hazards: (a) East Shore Station, 37926 127th Street, Aberdeen, SD, for employees engaged in water lift station construction and repair operations with potential exposure to oxygen deficient and/or toxic gas atmospheres where safe entry procedures were not performed. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ASSE Z117.1-Safety Requirements for Confined Spaces which includes, among other requirements, the following: 1. Institute a confined space entry program. 2. Develop an atmospheric testing program. 3. Develop and implement an effective training program.
