Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from container handling: (a)Onboard M/V APL ENGLAND,bay two, main deck: A hatch boss was exposed to possible injury from being struck by a falling or swinging container or the contents of container when he was working within eight feet of where the crane was discharging cargo. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD: 1.Ensure employees are not allowed to walk or work in the aisles adjacent to a container bay being loaded or discharged. Reference: Pacific Coast Maritime Safety Code, 2002 Revision, ILWU-PMA, Section 15, Rule Number 1513.
