Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic: a) Employees were working in and on the side of a heavily traveled road without wearing traffic safety vest or safety cones placed. Among other methods recognized and feasible means of abatement to correct this hazard is to: a) Ensure employees set out traffic safety cones and wear suitable traffic safety vest. b) Comply with the applicable elements required by the Manual on Uniform Traffic Control Devices.
