Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards while attempting to start a disabled gasoline engine powered cement mixer. (a) Yard: On or about 07/14/2009, an employee sustained severe burns while pouring flammable gasoline into the carburetor of the cement mixer while another employee was attempting to start it. The vapors ignited, which caused the burns to the employee. Among other methods, one feasible and acceptable abatement method to correct this hazard is to take the cement mixer to a qualified mechanic for repairs so employees are not exposed to fire hazards.
