Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while lifting steel I-beams from an unapproved lifting point. (a) Jobsite - Sakonnet River Bridge Project: On 10/23/2009, on or about 09:30, an employee was struck-by and pinned to the ground when a 3,826 pound steel I- beam load being lifted with synthetic web slings attached to a bucket tooth of a CAT 350L excavator slipped off the lifting point. Among other methods, feasible and acceptable abatement methods include, but are not limited to the following: a. Follow the Operation & Maintenance Manual for the 350 & 350L excavators which states "Use the lifting bar provided on the linkage to lift objects." b. Follow the Association of Equipment Manufacturers Safety Manual for Operators and Maintenance Personnel for Hydraulic Excavator which states "Attach chains and slings to the manufacturer's designated lifting points on the excavator bucket". "ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM"
