Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of falls or sliding to lower elevations due to
a collapsing temporary
ramp.
(a) Jobsite - rear of building under construction: On or about 4-9-10, an
employee working at
the edge of a temporary dirt ramp slid approximately 18 feet down the edge
of the ramp and
sustained a serious injury. The portion of the ramp the employee was
standing on collapsed,
causing the employee to slide. The soil condition was wet at the time of
the incident due to rain
being experienced, and the employer had not undertaken any means to
support the edge of the
ramp to prevent collapse of the loose dirt.
Among other methods, one feasible and acceptable method of abatement would
be (a) to ensure
ramps are engineered and constructed to provide for adequate support at
its edges to prevent
collapse. (b) to provide adequate protection at the edge, in the form of
rails or barriers, to
prevent employees from falling or sliding from the edge of the ramp.
