Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to THE HAZARD OF BEING STRUCK-BY:
a)On or about 8/18/08, County Route 125:  An employee was collecting trash
utilizing a Mack truck with a Leach Packmaster body.  The truck was being
operated and parked on the wrong side of the road, in the on coming lane of
traffic, before sunlight.  The employees were not wearing any high
visibility
clothing.
Feasible and acceptable abatement methods, among others, to correct this
hazard
is:
1) Comply with the American National Standards Institute (ANSI) Mobile
Refuse Collection and Compaction Requirements ANSI Z245.1 and
2) Train employees under section 6.1 of ANSI Z245.1.
3) Ensure that employees wear high visibility clothing as required in 23
CFR
part 634 and the Manual of Uniform Traffic Control Devices (MUTCD)
Section 6D.03. and
4) Ensure that employees do not drive and park in the oncoming lanes of
traffic as is described in the New York State Vehicle and Traffic Law,
Article
25, Section 1120.
