Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a)Spray booth area, on or about 04/01/09, a Dayton 1/2 ton overhead electric hoist had a lower limit safety switch that did not function in accordance with the manufacturer's manual and no recorded annual inspection had been conducted. Among other methods, several feasible and acceptable abatement methods to correct this hazard are to: 1.Repair or replace the lower limit switches and ensure they are adjusted to meet the requirement of the manufacturer's operation manual, Checking limit switch operation and ANSI B30.16 1973-1993, Overhead Hoists, Section 16, Paragraph 2.3.3, Adjustments, Repairs, and Replacements. 2.Conduct frequent and periodic inspections of the hoists in accordance with the manufacturer's manual and ANSI B30.16 1973-1993 Overhead Hoists, Section 16, paragraph 2.1, Inspection. b)Spray booth area, on or about 04/01/09, a locally fabricated below-the-hook spreader bar was being used to hoist material and no initial capacity rating, marked on the bar, and no recorded annual inspection had been conducted. c)Standard Product Cell area, on or about 04/01/09, a locally fabricated below- the-hook spreader bar was being used to hoist material and no initial capacity rating, marked on the bar, and no recorded annual inspection had been conducted. Among other methods, feasible and acceptable methods to correct each of these hazards are to: 1.Rate and mark the load capacity of all below-the-hook lifting devices on a tag/plate or equivalent. 2.Conduct frequent and periodic inspections of the lifting device in accordance with ASME B30.20-1993. Abatement certification must be submitted for these items.
