Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a)Pole Barn area, on or about 10/29/2009: Employees were operating, riding, and/or working in the vicinity of a Langley PowRlift, Model# EH102, Serial#M8823, Vertical Reciprocating Conveyor. Among other methods on feasible and acceptable abatement method to correct these hazards is to: 1) Install or locate controls so they cannot be actuated by a person on the carrier in accordance with ASME B20.1-2003, Safety Standards For Conveyors and Related Equipment, Section 6.21.2(e) Guarding Controls. 2) Fully enclose the conveyor by a gate system at the ground level so as to prevent death or injury from inadvertent contact by the conveyor in accordance with ASME B20.1-2003, Safety Standards For Conveyors and Related Equipment, Section 6.21.2(a) Guarding Enclosure. 3) Equip the conveyor housing with doors or an equivalent means at each manual loading and unloading stations, interlocked so that they can be opened only when the carrier has stopped at the level and such that the carrier cannot be actuated until they are closed in accordance with ASME B20.1-2003, Safety Standards For Conveyors and Related Equipment Section 6.21.2(b) Interlock Guarding. Abatement certification is required for this item.
