Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the load: a)The following below-the-hook lifting devices were not inspected and/ or had no rated load capacity markings or manufacturer's markings. 1)On or about 3/4/10, Building #4, First Floor Press Area: Below-the- hook lifting devices used to lift rolls of paper were not load rated. 2)On or about 3/5/10, Building #11C, Center Bag Palletizer: A below- the-hook lifting device used to lift plastic roles was not load rated. 3)On or about 3/24/10, Pan Room: A below-the-hook lifting device used to lift filters was not rated. 4)On or about 3/24/10, Building #11C: A below-the-hook lifting device attached to lift #41 was not rated. 5)On or about 3/24/10, Building #11C: A below-the-hook lifting device at the West palletizer was rated. Among other methods, feasible and acceptable abatement methods to correct these hazards are to: 1)Inspect and test the lifting devices in accordance with ASME B30.20- 1993, Section 20-1.3, Section 20-1.4 and Section 20-4.3. 2)Mark the rated load capacity on the devices along with the manufacturer's name, serial number and weight, for devices over 100 pounds in accordance with ASME B30.20-1993, Section 20-1.2. b)The following overhead hoists had deficiencies: 1)On or about 3/2/10, Pan Room: The load lines for the Shepard Niles 1/2 ton electric cable hoist were rubbing against the metal floor and the metal rails, causing wear on the load line. 2)On or about 3/24/10, Packaging Maintenance Room: Hoist #16, a Shepard Niles 1 ton electric cable hoist had a broken block case, and was running into a condensate line and its own power supply line. 3)On or about 3/24/10, Building #4, Press Area: Hoist #22, a Shepard Niles electric wire rope hoist was not reeved properly, was notprovided with a load rating on the hoist, and was operating on a jib that was not rated. 4)On or about 3/24/10, Building #11, West Palletizer: Hoist #46, a CM 300 pound, air, chain hoist had its controls suspended by its air lines. 5)On or about 3/24/10, Building #11, Palletizer: Hoist #41, a Jet 1/2 ton air chain hoist and rail were rated for 1/2 ton, the trolley was rated for 275 pounds. Among other methods, feasible and acceptable abatement methods to correct the hazards are to: 1)Mark the rated load capacity on the hoist or load block in accordance with ANSI B30.16-1993, section 16-1.1. 2)Mark the rated load markings on the jib in accordance with ANSI B30.11-1980 Section 11-1.1. 3)Inspect the overhead hoists in accordance with ANSI B30.16-1993, Section 16-2. 4)Ensure the supporting structure components are designed to withstand the loads in accordance with B30.11-1980 Section 11-2.2.2. Abatement certification must be submitted for this item.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by a structural collapse: a)On or about 3/5/10, Building #11C: Numerous structural support columns were damaged, with bent and/ or cut webs. b)On or about 3/9/10, Building 11A: A structural support column near the Hapman Hopper was damaged with bent webs. Among other methods, feasible and acceptable abatement methods to correct the hazards are to: 1) Utilize the services of a professional engineer to determine what repairs or replacements are needed, and then follow the engineers report. 2)Maintain the structure as required in Section 305.2 of the Property Maintenance Code of New York State. Abatement certification must be submitted for this item.
