Labor and Employment Article, Section 5-104(a), Annotated Code of Maryland: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:08/25/08 Location:Front of Building Equipment:Clark Forklift Condition:An employee was elevated approximately 16 feet above the ground level on a Clark forklift truck; the employee was working on an exhaust fan while standing on a closed step ladder which had been placed on a pallet, that was unattached to the forks. Among other methods, one feasible and acceptable method to correct this condition is to install a platform with guard rails and be tied off inside the platform.
