Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm in that
employees were exposed
to the hazard of possible fire and explosion from titanium metal shavings
stored and recycled
in a building where automatic sprinklers are present:
In the warehouse/recycling area:  On or about July 24, 2008, and at times
prior thereto,
employees recycling titanium metal shavings are exposed to the hazard of
fire/explosion, where
metal shavings are not properly stored or protected from water in the
event the sprinkler system
activated.  Titanium is a water reactive metal.
ABATEMENT:  Feasible abatement methods include following published
industry standards,
fire codes, and implementing appropriate housekeeping and storage
practices for water reactive
metals.
Or in the alternative, 29 CFR 1910.176(c):  Storage areas were no kept
free from accumulation
of materials that constitute hazards from tripping, fire, explosion, or
pest harborage.
