Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of struck-by, caught-in and amputation by pinch points. For employees using the dumbwaiter on or about August 5th, 2008: The employer did not ensure the hoist-way door opening was less than one (1) inch in each dimension around the dumbwaiter car. One feasible means of abatement for this hazard, among others, is to ensure equipment is maintained and operated in accordance with the manufacturer's operation/service manual and any recognized and generally accepted good engineering practices.
