Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of uncontrolled release of potentially volatile gas and/or liquid from the well. Reference: American Petroleum Institute, Recommended Practice 54; Sec. 6.4.1 For the employees working on the service rig on or about August 27th, 2008. The employer did not ensure blow out prevention equipment was installed on the well when natural gas was found to be flowing upon opening of the well.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of not having immediate access to a secondary means of escape, in the event of an emergency. Referenced in the American Petroleum Institute, Recommended Practice No. 54, Sec. 6.10.1. For the employee working in the derrick on or about August 27th, 2008. The employer did not provide an emergency escape device. Exposing employees to the hazard of becoming trapped in the derrick in an emergency, causing thermal or chemical burns or death.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed the potential hazard of thermal and/or chemical burns from the uncontrolled discharge of volatile gasses and/or liquids. Reference: Oklahoma Corporation Commission Regulation; OAC 165:10-11-6(e) For the employees working on the service rig on or about August 27th, 2008. The employer did not ensure volatile gases and/or liquids in the well were displaced with an inert material before performing work on the well. Employees were exposed to gas and liquid escaping from the well causing thermal burns.
