Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazards struck-by and crushed-by falling objects and unsecured loads: For work performed on or about on September 7, 2008, at an apartment complex, employees used an appliance dolly that was missing straps to secure appliances during movement, exposing the employee(s) to the hazard of being struck-by unsecured appliances during movement. One feasible method, among others, to eliminate or reduce the hazard is to ensure all appliance dollies are equipped with straps to secure appliances for safe movement. Material handling equipment shall be used and maintained according to generally accepted industry practice and manufacturer specifications.
